Beyond AI Risk: When Might Artificial Intelligence Deserve Rights?

As part of my philosophical research, I’ve ventured beyond the usual AI ethics discussions of risk and control to explore a fascinating question: under what circumstances might artificial intelligence warrant rights?
While most contemporary debates centre on AI safety and governance, my research examines how our expanding moral circle — which has historically grown to include previously excluded groups — might one day extend to artificial beings. This investigation, undertaken as part of my CertHe philosophy programme, delves into three fundamental considerations that challenge our assumptions about rights and moral status.
First, I explore the seemingly straightforward distinction between organic and artificial life, revealing unexpected complexities. When we examine questions of mortality, uniqueness, and replication, the traditional boundaries between ‘natural’ and ‘artificial’ begin to blur in intriguing ways.
The consciousness debate proves particularly challenging. Drawing from both functionalist and non-functionalist philosophical traditions, I explore how our limited understanding of consciousness — even in humans — complicates any quick dismissal of potential AI consciousness. After all, if we struggle to explain our own conscious experience, how can we definitively rule it out in artificial beings?
Perhaps most compelling is the consideration of suffering. My analysis suggests that the capacity for suffering might offer the most objective criterion for determining rights. While current AI systems don’t experience emotional pain, future developments could create entities capable of suffering in ways we might recognise and empathise with — much as we do with animals, though potentially with even greater understanding due to AI’s communicative abilities.
I propose an adaptive approach to moral obligations that maintains humans at the centre whilst acknowledging varying levels of responsibility toward different forms of sentient life. This framework allows for the possibility of including AI within our moral hierarchy while emphasising the importance of addressing our existing ethical obligations to humans and conscious organic life.
The implications are profound. As we develop more sophisticated AI systems, we may need to prepare for scenarios where artificial beings demonstrate a genuine capacity for suffering. This raises fascinating questions about consciousness, empathy, and the nature of our moral obligations.
My research suggests that while AI rights might seem distant, we need careful consideration now to prepare ethical frameworks that can accommodate future developments. Understanding consciousness — both human and artificial — becomes crucial for assessing our evolving responsibilities to both organic and artificial entities.
This exploration isn’t just about AI — it’s about understanding ourselves better and questioning the boundaries of our moral consideration. As technology continues to advance, these philosophical questions become increasingly relevant to our shared future.
